Safety and Health Committee

Safety Committees are a valuable part of your safety program.  Who participates and how often you meet will be up to your organization structure and needs.  But establishing safety committees is an excellent way management can encourage employees to participate in implementing and monitoring the company’s safety program.  When you develop your safety committee it is important to include employee representative for all departments…for example your technicians, office workers, maintainance, etc.  Members should be rotated periodically to allow for maximum involvement and increased safety awareness. 

Once an accident investigation is completed, it should be forwarded to the safety department to be reviewed at the next Safety Committee meeting. 

The Safety Committee should have an open discussion on the past accidents to determine if all the events leading up to the accident were identified, if corrective action was implemented and if the corrective measures are appropriate to prevent future incidents.  Witnesses, maintenance, supervisors, even the employees involved in the accident could be invited to the meeting to discuss the events and provide additional preventative recommendations.  This is not a process to assign blame, but rather a group effort to learn from the past and use that knowledge to prevent future accidents. The Safety Committee should also be looking for trends or problem areas while reviewing the accident investigations. 

The committee will have several roles, such as assist in the development, implementation, and periodic evaluation of the safety and health activities.  Meetings should be held regularly and all committee members must attend.  Minutes of the Safety Committee meeting should be recorded.

 The committee should be responsible for the following tasks:

  • Review existing safety and health rules and procedures to ensure that these rules are current, pertinent, and being followed.
  • Provide suggestions for employee training.
  • Review all accident reports to identify its root cause and determine appropriate corrective action by implementing one or more E.S.P. techniques:
    *    Engineering Controls
    *    Safe Work Practices
    *    Personal Protective Equipment
  • Audit the results of all safety inspections conducted.
  • Review training programs with particular attention being given to training involved in the following areas:
    *    New or transferred employees.
    *    New safety and health regulations.
    *    New or modified procedures or processes.
    *    New equipment or chemicals.
  • Be involved in preliminary hazard analysis for new equipment, new processes, and new designs.
  • Conduct periodic in-house safety inspections.
  • Provide recommendations to management on safety and health issues.
  • Evaluation of the safety and loss prevention program.

Local Law 196 of 2017: Site Safety Training (SST) Curriculum

Recent NYC Local Law 196 of 2017 requires workers and supervisors performing most construction activities within all NYC Borough jurisdiction receive safety training. The safety training requirements will be phased-in in three parts beginning on March 1, 2018, with full training being required no later than September 1, 2020.  NYC Department of Buildings will mandate that workers at certain job sites have 40 hours of safety training and that supervisors have 62 hours of training.  For more details on Local Law 196 please visit NYC Department of Buildings links below…..

OSHA 30-HOUR CONSTRUCTION SAFETY

November 27, 28, 29, & 30th
This course meets the training requirements of New York State Labor Law 220-h. This regulation requires all laborers, workers, and mechanics, working on construction, reconstruction, maintenance and/or repair of public work, where the total cost of all work to be performed under the contract is at least two hundred fifty thousand dollars, must have successfully completed one of these courses. This includes the contractor and all subcontractors. This course also meets the training requirements of New York City Department of Buildings Local Law 41 of 2008. This regulation requires all workers on a major building project must have taken this course in the last 5 years (However, for NYC you would not need to take this course every 5 years you could take the 10-hour construction course)
This course covers OSHA policies, procedures, and standards, as well as construction industry safety and health principles. Upon successful course completion, the student will receive an OSHA construction industry safety and health 30-hour course completion card mailed from OSHA. The 30-hour course is four days of training.

C240 Form:  Employer’s Statement of Wage Earnings (Prior to the Date of Accident)

This form should be completed any time the lost time exceeds the 7 calendar day waiting period. This will provide the Carrier with the necessary information in order to calculate an average weekly wage which will be the basis for the Workers’ Compensation benefit.

  • Give gross weekly earnings for the 52 week period immediately prior to the date of the accident.
  • If the injured worker has not worked at the same work for a year or a substantial part of the year give the weekly gross earnings of another employee of the same class who has worked for a year or a substantial part of the year prior to the date of the accident.

C11 Form: Notice of Return to Work / Change in Employment Status

Form C-11 must be completed as soon as the injured worker’s employment status changes from what was reported on the eFroi or previously submitted C-11.

Change in employment status, if related to the injury, includes the following:

  1. Return to work
  2. Discontinuance of work
  3. Increase/decrease of regular hours of work
  4. Increase/decrease in wages

C107 Form: Employer’s Request for Reimbursement

This form is used if the employer has made advance payment of compensation (continued wages) during any period of workers compensation disability. The employer shall be entitled to reimbursement, if desired, at the compensation rate as determined by a Workers Compensation Law Judge. 

  • This is optional and not recommended as you may not receive full reimbursement.
  • Payments will be reimbursed at the Workers’ Compensation rate only.
  • Updated C107 must be completed on a regular basis while injured worker is being paid a continued salary.
  • Reimbursement can only be done at a hearing so it may take some time to receive.
  • Sick or vacation time will need to be credited back to the injured worker once reimbursement is received, unless you elect not to receive reimbursement at which time payment will be made directly to the injured worker.

Employers have the option to pay for the medical treatment out of pocket if the employee did not lose time from work beyond the work day on which the accident occurred and/or received no more than 2 medical treatments. The injury should not result in permanency (example facial scars, ligament or tendon injuries).

  • First aid is not intended for neck, back, hip and joint injuries. Example of first aid claims includes lacerations, foreign body in the eye, nail bed injuries, etc.
  • If a claim is questionable do not pay it as first aid.
  • If the claim goes beyond first aid you must advise us immediately.
  • Employers are required to keep a record of all injuries, including first aid, for 18 years. Please complete first aid form and forward to our office for documentation purposes only.
  • Advise medical provider to bill you directly.
  • Medical bills should be forwarded to our office to determine the amount under the Medical Fee Schedule which you are responsible to pay.

Filing NYSIF Work Comp Claims – Things to know:

Claims must be filed within 10 days of injury

WCL Section 110(4), the Board may impose a penalty up to $2,500 against an employer who repeatedly refuses or neglects to file First Report of Injury.

  1. Go to www.NYSIF.com\reportinjury
  2. Click filing a timely first report of injury using NYSIF eFROI®
  • The electronic first report of injury report (eFroi) is a legal document and YOUR statement regarding the alleged accident. Do not let the injured worker complete form on your behalf.
  • We suggest you phrase accident details with “injured worker alleges….” Or “injured worker claims…..”.
  • If the accident occurred on a construction OCIP/CCIP job the claim would be reported to the OCIP/CCIP Carrier not NYSIF.
  • Provide copy of Claimant Packet to the injured worker upon filing the claim.
  • Once the eFroi is submitted it will get routed to us and NYSIF for handling. Please forward any supporting documents to claims@Keevily.com

Your W/C Responsibilities as an Employer

When an employee has a workers compensation injury you need to take action.

Communication – stay in touch with your employees while they are out of work to obtain updates and encourage the injured worker to return to work as soon as possible. Request Out of Work slips for all lost time periods.

Employee’s Responsibilities

  • Seek medical treatment, as needed.
  • Promptly report ALL job-related accidents, illnesses or near miss situations to your supervisor immediately or as soon as you have knowledge in the case of any illness.
  • Follow with your physician treatment plan.
  • Provide a physician’s out of work note for all periods of absences.
  • Attend Independent Medical Examinations.
  • Go back to work as soon as you are able.
